Investing in Safe, Sustainable Wastewater Service

The study reviews our water and sewer system’s full costs—covering operations, maintenance, and capital improvements—to ensure that every dollar collected through rates is used solely to provide safe and reliable water and sewer service.

Proposition 218 (Article XIII D of the California Constitution) requires that:

• Water and sewer rates must not exceed the cost of providing service.
• Charges must be proportional to the cost of service attributable to each parcel.
• Revenue cannot be used for purposes other than water and sewer services respectively.
• A public notification and protest process must be followed before rates are adjusted.

This ensures that rates are based strictly on cost-of-service principles—ensuring fairness and preventing overcharges.

The City has not raised water and sewer rates in over 12 years, yet costs for operations, maintenance, and capital improvements have risen due to inflation and aging infrastructure.

The proposed rate adjustments are calculated to only recover actual costs and create financial stability.

Prop 218 guarantees transparency through a public process:

1. Notice: A written notice of the proposed rate adjustment will be sent to all property owners at least 45 days in advance of a public hearing.
2. Public Hearing: Residents can submit written protests or attend the hearing to provide input before the rates are adopted.
3. Majority Protest Process: If a majority of parcel owners submit written protests, the City cannot implement the new rates.

Delaying rate adjustments has serious consequences, including:

• Deficits and higher long-term costs: The City cannot legally operate at a deficit, meaning emergency repairs would require sudden, larger rate increases in the future.
• Deferred maintenance: Aging pipes, pumps, and facilities will fail, leading to service disruptions, costly emergency repairs, and potential state intervention.
• Legal and financial risks: If the City does not maintain financial stability, it may lose access to state and federal grants, leading to higher costs for residents.

No. Under Prop 218 (§6(b)(2)), water and sewer revenues must be used exclusively for the cost of providing these respective services. Funds cannot be transferred to the general fund or used for unrelated City expenses.

If approved, the new rates will take effect after the required Proposition 218 process, including a public hearing and protest period. The effective date of the rate adjustment is July 1, 2025.
